What New Jersey investors should know before they buy

Attorney review can change your timeline

New Jersey residential sale contracts prepared by real estate licensees for one-to-four family properties include a three-business-day attorney review period, during which either side's attorney can modify or cancel the contract. Your financing clock effectively starts when attorney review ends.

Closing customs differ north and south

In North Jersey, attorneys usually represent each side through closing. In South Jersey, it is common for a title company to handle the closing without separate attorneys. Know which model your deal follows so documents are ready on time.

Resale certificates matter to flippers

New Jersey requires a smoke alarm, carbon monoxide alarm and fire extinguisher compliance certificate before a one- or two-family home is sold, and many municipalities also require a continued certificate of occupancy inspection. Schedule these into the end of your renovation so they do not delay the sale.

Transfer fees are paid at sale

New Jersey charges a realty transfer fee when property is sold, with additional fees on higher-value transactions. As a flipper you are the seller, so include these in your exit costs. Get current figures from your attorney or title company.

Flood zones and substantial improvement

At the Shore and along rivers, properties in a flood zone need flood insurance, and a renovation costing more than half the structure's value can trigger requirements to bring the building up to current flood-elevation standards. Check the flood zone before you set the scope.

Lead-safe rules for rentals

If you plan to hold and rent, New Jersey requires lead-based paint inspections for many rental dwellings built before 1978. Factor the inspection and any remediation into a buy-and-hold budget.
